Transunion, Equifax and Experian all have programs to protect you if you believe fraud has been perpetrated against you. If there has been a cyber breach at your servicer (there have been many and they are increasing), your credit could be impacted by things that are not your fault. To avoid this, a credit freeze restricts the credit rating agency from sharing your score with any party for seven years without your direct and expressed permission. You will be able to release your credit scores on a case-by-case basis at your discretion.
Every case is unique and every story different. Servicers vary significantly in complying with laws and regulations. Some have systems issues. Others don't communicate well internally across departments. We make it a standing practice to review for all potential Elements of Harm™ by understanding your timeline of events, communications and interactions with your servicer, and following the money with fees and charges which impact you.
Per the Real Estate Settlement Procedures Act (RESPA), you have the right to see everything your borrower has documented on you - every note in their files and computer screens. By law, your servicer must confirm they have received your QWR within 5 days of receipt and provide all the requested content within 30 days of receipt. By the same law, when your Servicer makes a mistake or you find an error in the documentation you receive, you may write a Notice of Error which requires the Servicer to correct the error or respond as to why it is not deemed an error. This forms the basis for additional legal action and protective measures you can take as next steps. We will write the bespoke Notice of Error for your case.
The CFPB is a U.S. government agency dedicated to making sure you are treated fairly by banks, lenders and other financial institutions. Filing a complaint with the CFPB is taken seriously by this US regulatory agency. Complaints specifically identify the harms perpetrated by the servicers or financial institutions. Your name is held privately but the anonymous complaint is public and available to interested parties. It is easy to see patterns of abuse and harms caused by certain financial institutions. Each week the CFPB sends about 25,000 complaints to companies for their response. They typically respond within 15 days. And ideally, they address the harm they have caused although not always the case. This is an important step to take.
For mortgage foreclosures, you are automatically protected by the SCRA when you are deployed. By law, SCRA can prevent foreclosures and other civil actions, while you are deployed and up to 12 months after your return. However, you should take every precaution to ensure that your bank, your mortgage servicer, and any other creditor is fully aware that you are on active duty, deployed, and protected by SCRA. For non-mortgage related credit, you must request SCRA protections prior to your deployment departure date.

We understand that you and your family have gone through tremendous pain and it is hard to bring it up again.
